1. Who We Are

 

Supermind provides EEG-based biofeedback, brainwave data analysis, mindfulness coaching, and mental fitness programs that support non-medical self-improvement. Our services are wellness-oriented and educational in nature and are not intended as healthcare or psychotherapy.

 

2. Eligibility

 

You must be 18 years or older, or have the consent of a parent/guardian, to use our Services.

 

3. No Medical or Psychological Services

 

Supermind is not a licensed medical or psychological provider. We do not diagnose, treat, or cure any mental health, medical, or psychological condition. Our services are not a substitute for professional medical advice. Clients are encouraged to maintain appropriate care with licensed healthcare professionals.

 

4. Biometric and Sensitive Data Consent

 

By using Supermind’s Services, including EEG biofeedback, you understand and consent to the collection and processing of biometric data (e.g., brainwave activity), which may be considered sensitive data under applicable privacy laws. All such data is handled in accordance with our Privacy Policy and anonymized for research and development purposes unless otherwise specified. Users may withdraw consent for data use at any time.

 

5. Intellectual Property

 

All content on this site and used in our Services (including audio, video, text, session materials, visualizations, and training protocols) is the property of Supermind Inc. You may not reproduce, copy, resell, modify, or distribute any materials without prior written consent.

 

6. Electronic Communications

 

By using our website or booking services, you consent to receive communications from us electronically, including emails, SMS, or other notices. You may opt out at any time by following unsubscribe instructions in the communication.

 

7. Payments and Refunds

 

Payment is required before sessions unless otherwise agreed. Certain prepaid packages or offers may have their own refund terms. Unless explicitly stated, all purchases are non-refundable. See your signed Client Consent Form for package expiration, late cancellation fees, and refund policies.

 

8. No Guarantee of Results

 

Supermind makes no claims, warranties, or guarantees of specific outcomes. Individual results will vary based on a range of personal factors.

 

9. Limitation of Liability

 

To the fullest extent permitted by law, Supermind shall not be liable for any indirect, incidental, special, or consequential damages, including personal injury, emotional distress, loss of profits, or data, arising out of your use of the Services.

In any case, Supermind’s liability is limited to the amount you paid for Services. Some jurisdictions do not allow certain limitations, so portions of this clause may not apply to you.

 

10. Right to Refuse or Terminate Services

 

Supermind reserves the right to terminate or refuse service to any user at its discretion, especially in cases where continued participation may be deemed unsafe, inappropriate, or disruptive. Clients may be referred to licensed medical or mental health professionals if necessary.

 

11. Force Majeure

 

We shall not be liable for delays or failure to perform due to causes beyond our reasonable control, including natural disasters, governmental actions, war, terrorism, labor strikes, pandemics, or technological outages.

 

12. Changes to Terms

 

We reserve the right to update or revise these Terms at any time. Material changes will be announced via website updates or email. Your continued use of the Services after any change indicates your acceptance of the updated Terms.

 

13. Dispute Resolution

 

All disputes related to these Terms shall be resolved through binding arbitration in Miami, Florida, under the rules of the AHLA Alternative Dispute Resolution Service. Parties agree to first attempt mediation before initiating arbitration. This constitutes a waiver of the right to a jury trial.

 

14. Governing Law

 

These Terms shall be governed by the laws of the State of Florida, without regard to conflict of law principles.
